The City Attorney's Office provides legal advice and counsel for the City Commission, city departments, boards, and special districts regarding civil issues such as contracts, claims, employment, and other administrative and legislative functions. The attorneys also represent the city in litigation and act as the primary contact person when outside counsel is retained to represent the city. The City Attorney does not represent individual citizens or businesses but may be called on by city staff to answer legal questions raised by the public related to city ordinances. The City Attorney also represents the City of Bozeman Board of Ethics and may issue formal and informal opinions regarding the city's ethics ordinances.
In addition to the City Attorney's civil functions the City Attorney's Office prosecutes misdemeanor criminal offenses of the Bozeman Municipal Code and state law. Because Montana State University lies within the city jurisdiction, any criminal offenses in which the defendant is cited by Montana State University Police are also prosecuted by the City Attorney's Office.
