Fireworks

 

The Bozeman City Commission amended the Bozeman Municipal Code to allow certain types of fireworks to be discharged during limited hours around the 4th of July and New Years Eve.  This is an exception to the general ban on all fireworks in the City limits without a permit.  Fireworks may not be sold within the City at any time. 

 

Allowable Fireworks: Allowable fireworks are described as "Class C" by federal law and criteria of permitted fireworks are listed on the reverse side.

  •         Cardboard or heavy paper cylindrical tube or cone that:
  •         Produces a shower of color and sparks that reach a maximum of 15 feet;
  •         May whistle or pop; and
  •         Is not designed to explode or leave the ground.
  •         A pyrotechnic wheel device:
  •         May be attached to a post or tree; and
  •         Contains no more than six "driver units or tubes.
  •         Any device that:
  •         Spins, jumps or emits popping sounds when placed on the ground;
  •         Does NOT exceed a height of 15 feet when discharged; and
  •         Does NOT travel laterally more than 10ft on a smooth surface when discharged; and
  •         Does not travel laterally more than 10ft on a smooth surface when discharged;
  •         Sparklers under 12 inches in length which do not have a magnesium make-up, glow words, snakes, party poppers, trick noisemakers;
  •         Certain mortar type aerial devices and multi-shot cakes that are found acceptable by the Director of Public Safety.

 

Time & Place Limitations:  Fireworks may be discharged within the city limits ONLY on private property of the owner, or with the owner's permission or on paved city streets which are not arterial or collector streets and is done so in a "safe and sane" manner.  The discharge of these fireworks is limited to the following schedule:

4th of July Holiday

Between noon July 3rd and midnight July 4th

Between noon July 4th and 1:00am July 5th

Between noon July 5th and midnight July 6th

New Years Day Holiday

Between 11:00pm December 31st and 1:00am January 1st

 

 Violation is expensive:  Violation of the provisions may result in a misdemeanor charge and a fine of up to $500 (not less then $100 on the first offense) if convicted.

 

Citizen Responsibilities

          Know and understand the ordinance before discharging fireworks ask firework stand attendant to identify Class C fireworks.

         Be a good neighbor be considerate of your neighbors, their property and enjoy the holiday without ruining others experience or sacrificing safety.

        Help others to be educated help others to obey the ordinance by sharing this information.
