BOARD OF APPEALS
This board meets as needed.
The Board of Appeals is created under Commission Resolution No. 2483, adopted October 3, 1993, and is authorized to "…determine the suitability of alternate materials and methods of construction and to provide reasonable interpretation of the following codes of the City of Bozeman: Building Code, Electrical Code, Mechanical Code, and Plumbing Code."
The Board is to be comprised of five members appointed by the City Commission "who are qualified by experience and training to pass upon matters pertaining to building construction." The Building Official is an ex officio member and shall act as secretary of the Board. The Uniform Building Code provides for the creation of the Board of Appeals under Section 204 and contains the same language as the resolution. Since the Board may consider appeals to the various technical codes, a broad-based board is desired. Under the resolution, members shall serve staggered three-year terms.
The Board is quasi-judicial, with its decisions to be appealed to the District Court.
