Tax Deductibility of Donations: We advise people to
contact their income tax professional, as an individual's tax circumstances can
effect deductibility of charitable contributions. The City of Bozeman, per
se, is not exempt under 501(c)(3), but instead qualifies as being tax exempt
under Section 170.
The IRS Code recognizes that "an organization that is exempt from federal income
tax other than as an organization described in section 501(c)(3) may, if it
desires, establish a fund, separate and apart from its other funds that will
thus qualify." Pursuant to IRS Publication 557, therefore, the City of
Bozeman's Story Mansion Construction Fund qualifies for Section 501(c)(3)
treatment under the Internal Revenue Service Code.
